Refer a Business. Earn Ongoing Commissions.

1. Eligibility

The Akima Automations Referral Program (“Program”) is open to any individual or entity (“Referrer”). No prior approval is required to participate. The Referrer must not be the owner, director, or employee of the business being referred. Existing Akima Automations clients cannot be referred.

2. Commission Structure

For each qualifying referral, the Referrer earns:

• One-time bonus: $100 AUD, paid after the referred client (“Referred Client”) has maintained an active, paid subscription for 3 consecutive months.
• Recurring commission: 10% of the Referred Client’s actual monthly subscription payment, paid monthly in arrears for 12 months (months 4 through 15 after the Referred Client’s subscription start date).

3. Retention Requirement

No commission (including the one-time bonus) is payable unless the Referred Client completes 3 consecutive months of active, paid subscription. If the Referred Client cancels, pauses, or otherwise ceases their subscription before the 3-month mark, no commission is earned.

4. Payment Terms

• Commissions are paid net 15 days from the end of the calendar month in which the commission is earned.
• Payment is made via bank transfer (Australian accounts) or PayPal (international).
• All commission amounts are in Australian Dollars (AUD) and are exclusive of GST where applicable.
• The Referrer is responsible for any tax obligations arising from commission payments.

5. Plan Changes

If the Referred Client upgrades or downgrades their subscription during the commission period, the recurring commission adjusts to 10% of the new monthly payment from the effective date of the change.

6. No Clawback

Commissions that have already been paid to the Referrer are non-refundable and will not be clawed back, even if the Referred Client subsequently cancels their subscription after the 3-month retention period.

7. Restrictions

• The Referrer cannot refer themselves, their own business, or any entity they have a controlling interest in.
• Businesses that are already Akima Automations clients at the time of referral are not eligible.
• The Referrer must not make false, misleading, or deceptive claims about Akima Automations or its services.
• Spam, unsolicited bulk messaging, or any activity that violates the Spam Act 2003 (Cth) is prohibited.

8. Tax Compliance

Australian-based Referrers must provide a valid ABN and/or TFN before commission payments can be processed. Referrers are responsible for reporting commission income and paying any applicable taxes. Akima Automations may issue payment summaries or RCTI (Recipient Created Tax Invoices) as required by the ATO.

9. Program Modifications

Akima Automations reserves the right to modify, suspend, or terminate the Program at any time. Referrers will be given at least 30 days’ written notice of any material changes. Referrals made before the effective date of any change will be honoured under the terms in effect at the time of referral.

10. Limitation of Liability

Subject to obligations under Australian Consumer Law, the total liability of Akima Automations under the Program to any Referrer is limited to the total commissions earned by that Referrer in the 12 months preceding any claim.

11. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes arising under these terms are subject to the exclusive jurisdiction of the courts of New South Wales.
